INTRODUCTION

Hayes, Inc. (“Licensor” or “we”) has two components to its web offering. The first is our public website (www.hayesinc.com), and the second is our Knowledge Center (https://www.hayesinc.com/subscribers/). The Knowledge Center is available only by subscription and requires a user ID and password for access. The following information describes our privacy policy for Knowledge Center subscribers, users, authorized users and corporate website users (“you” or “users”) for both the subscription and the non-subscription components of our web offering.

PRIVACY POLICY

Information Collection: This section describes how we collect information from you, why we collect this information, how we will use or disclose this information, and how we protect this information.

For all users, we will collect and log your IP address. Intranet IP addresses may be passed on to us via the sharing of a log file. An IP address is a number automatically assigned to a computer whenever a user accesses the Internet. IP addresses allow computers and servers to recognize and communicate with each another. We will collect IP address information to properly administer the system and to gather information on users of our site and how the site is being used, including the pages being viewed. We associate IP addresses with records containing personal information. Personal information is information that can be used to identify or contact users. We collect and store the company name and the user’s name and e-mail address. Users may also provide their title, phone number, and affiliation (if any), in which case the information is stored and can be used to further identify a user. We may use IP address information to personally identify a user in order to enforce our legal rights, or when required to do so by law enforcement authorities.

Cookies: We also collect anonymous, non-personal information about site usage through the use of “cookies”. Cookies are small data files that are transferred to the browser file of your hard drive that identifies your browser to our server whenever you interact with our site. This allows us to track initial and returning visits, browsing patterns on our site, and reports viewed. In addition, we collect the domain name of the server from which users are visiting. This can provide information relating to the sources of traffic on our site. Collecting this information does not allow us to personally identify users; however, you may elect to use the “remember me” convenience, which is enabled by the use of an encrypted cookie that contains personally identifiable information. Web Beacons, Pixel Tags: We may use web beacons on some pages of our site. A web beacon (also known as a pixel tag) is a graphic image that is used to better understand browsing patterns of site users. Information such as a user’s IP address, time of viewing, and browser type used can be gathered.

E-mail Communications, Surveys, and Related Services: We collect personal information that you choose to provide to us via feedback forms, e-mails, or online surveys. This information may include e-mail addresses and answers to questions. Our site may provide you with the ability to receive communications from us. Once you have decided to receive communications, you may later decide to stop receiving them. To stop receiving such communications, you may send an e-mail message to ClientServices@hayesinc.com with “Unsubscribe” in the subject line.

You acknowledge that all information submitted on our site is considered publicly accessible and that you should protect important and private information. We are not responsible for the protection or privacy of electronic mail or other information transferred through the Internet or any other network provider that you may utilize.

Blog: We collect the name and e-mail address of users who submit blog comments. The e-mail address is not published publicly. The submitted comments are moderated and approved to keep inappropriate messages from being posted.

Links to Other Sites: This agreement applies only to your authorized use of our site. Our site contains links to other sites, including, but not limited to, professional organizations and government agencies. We are not responsible for the privacy statements and/or terms and conditions of those sites, nor do we endorse the content on any third-party websites. We are not responsible for the content of linked third-party sites, sites framed within our site, or third-party advertisements, nor do we make any representations regarding their content or accuracy. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such sites.

Disclosure and Protection of Information: Except as set forth in this Agreement or as specifically agreed to by you, we will not disclose any personal information we gather from users of our site. We will not release personal information to third parties unless (1) we advise you how information will be used and you give us specific permission to share this information or (2) we are required to disclose such information by applicable law or legal process. Where we disclose any identifying personal information to third parties with your authorization, we will direct the recipient to use the information only for the purpose provided.

We have relationships with third parties. If you subscribe to a third party “value-added” partner and subscribe to the Hayes Knowledge Center, we will provide information to the value-added partner regarding general traffic, site usage, and length of stay on the site. This information may contain personal information about users. We will not sell, publish, or release any collected personal information to advertisers or non-authorized third parties.

SECURITY PROCEDURES

Standards: We use commercially reasonable security procedures to protect collected information from misuse or unauthorized disclosure. However, like other Internet sites, we cannot guarantee that our site is completely secure from unauthorized attempts to evade security measures or intercept transmissions over the Internet. Similarly, we cannot ensure the privacy of e-mail communications to and from our site. These communications, like most Internet e-mail, could be intercepted without knowledge or permission.
